What Compensation Can I Pursue in a Wrongful Death Claim?

Many families will endure an array of costs following the wrongful death of a loved one. These costs can include funeral, burial, and medical expenses if the victim passed while receiving treatment. Many pursue damages for pain and suffering, too. You could also recover lost income for taking time off work in light of your loved one’s passing.

Although there’s a chance your suit could be decided in court, most of these cases are resolved by an out-of-court-settlement.

The wrongful death attorneys at Loncar Lyon Jenkins will listen to your story, learning about not just the costs that resulted from your loss but how it has impacted the well-being and health of you and your family, and negotiate a settlement for an amount that reflects that. We are always prepared to take cases to trial, so we will not hesitate to litigate your case in Potter County if it means recovering fair compensation.

How Texas Defines Wrongful Death

There are numerous circumstances that Texas defines as a wrongful death, according to Texas Civil Practice and Remedies Code § 71.002(b). If an unintentional injury was caused by someone else’s “wrongful act, neglect, carelessness, unskillfulness, or default,” this could be grounds for a wrongful death suit.

For example, a death resulting from a car accident may not always be considered a wrongful death, but if it was due to someone driving irresponsibly, like driving drunk, that person would be liable. Wrongful death suits apply to both a person and unborn children.

Determining Liability in a Wrongful Death Case

If an individual, corporation, or other group caused an injury resulting in death through neglect or incompetence, they are liable. The liable party is responsible for the costs arising from the wrongful death. Our team can prove liability by establishing the following elements of negligence:

  • Duty of care: The liable party had a responsibility to keep your loved one out of harm’s way.
  • Breach of duty: They violated their duty of care by acting with negligence.
  • Causation: Their negligence was the cause of your loved one’s death.
  • Damages: Your family suffered damages as a result of the accident that fatally injured your loved one.

Who Can Be Held Liable in a Wrongful Death Claim?

Common liable parties in wrongful death cases include:

  • Drunk, distracted, or reckless drivers
  • Commercial or residential property owners who do not maintain safe premises
  • Construction site owners or managers
  • Product manufacturers or sellers

Regardless of who is at fault, our team will fight for the justice you deserve in your wrongful death claim.

Common Unintentional Injuries That May Entitle You to a Wrongful Death Settlement

Here are some of the common causes of unintentional injury deaths and examples of how they could relate to a wrongful death case:

Accidental Poisoning

One cause of unintentional injury deaths is accidental poisoning. If a loved one purchased a product or ate at a restaurant that served them tainted, improperly stored, or expired ingredients that led to illness and death, that could be grounds for a wrongful death case. This is an example of accidental poisoning caused by the negligence of the liable party.

Unintentional Falls

Another common cause of unintentional injury deaths is slip and fall accidents. An example of possible wrongful death suits for unintentional falls could be falling from a structure that wasn’t structurally sound in accordance with the law.

Other examples include falling from somewhere without a railing that needed one or slipping on a wet surface in a business that neither dried the floor nor put up a “wet floor” sign.

Motor Vehicle Accidents

Likely not a surprise, the next most common cause of unintentional injury deaths is motor vehicle accidents. Someone could be liable for wrongful death in a car accident if they were driving recklessly, under the influence of drugs or alcohol, or engaging in other irresponsible behavior.

Your Amarillo wrongful death lawyer will investigate your loved one’s wrongful death, identify the liable party, and pursue them for damages. We will fight tirelessly to hold the responsible party accountable for their negligence and see justice served.

What is the Statute Of Limitations for Wrongful Death in Texas?

In Amarillo, you must adhere to the statute of limitations when you file a wrongful death lawsuit. According to Texas Civil Practice and Remedies Code § 16.003, you generally have two years to submit your case.

Our wrongful death attorneys can ensure you’re aware of this filing deadline. We will work to turn your case in on time so that you don’t miss your opportunity to hold the liable party accountable.
