What is Considered Distracted Driving?

Distracted driving is anything that takes the driver’s attention away from the road. 

This can include behaviors such as:

  • Texting
  • Talking on the phone
  • Talking to a passenger
  • Searching for something in the vehicle
  • Paying attention to a
  • GPS device
  • Adjusting the radio or the vehicle’s controls
  • Eating and drinking
  • Applying makeup
  • Turning around in their seat to speak with a passenger in the back

What Are the Different Types Of Distracted Driving?

Distracted driving involves any type of activity that takes a driver’s attention away from the road. 

There are three types of driving distractions:

Visual Distractions

A visual distraction will cause the driver to take their eyes off the road. Examples can include checking the radio or GPS or adjusting the temperature controls in the vehicle.

Manual Distractions

A manual distraction will cause the driver to remove their hands from the wheel. This type of distraction can include checking their phone, smoking, eating, or drinking.

Cognitive Distractions

A cognitive distraction will take the driver’s focus away from driving. This can include speaking to passengers or driving under the influence of drugs or alcohol.

Distracted Driving Laws in Texas

As of 2017, texting while driving is illegal in Texas. This law targets drivers who are texting, playing, reading, or holding their phone to talk. Essentially, the law targets any driver who has a cell phone in their hand and is actively using it. The law does not target drivers who use their cell phones hands-free. 

In Texas, driving and texting is a misdemeanor. Anyone that violates this law may receive a fine between $25-$99. Repeated offenses can result in a fine of up to $200. If a serious injury or fatality results due to texting while driving, the motorist may be fined up to $4,000 and may be faced with one year in jail.
