How Can a Car Accident Lawyer Help After a Distracted Driving Collision?
After a motor vehicle collision, if you suffered injuries, you may be out of work and facing a long road to recovery. During this time you must pursue legal action to recover all accident-related costs.
At Loncar Lyon Jenkins, our legal team will help guide you through the insurance claims process every step of the way.
When you work with an auto accident lawyer on our legal team, they will also help by:
Reviewing the Police Report
Your attorney may review the accident report to determine if the other driver said anything that could support your claim. The other driver may have admitted to talking on the phone or texting at the time of the accident or may have apologized for the accident. Law enforcement will note anything the driver stated when they are questioned. The officer may also note if they believed that driver inattention was a contributing factor to the accident.
Obtaining the Other Driver’s Cell Phone Records
Your attorney can also subpoena the other driver’s phone records. Calls, emails, and texts will have timestamps that will show when they were made or sent. The driver’s cell may also have metadata that shows when their screen was active and what applications were being used.
Interview Witnesses
A witness may have seen the driver engaging in distracted driving behaviors.
After they have gathered and reviewed the evidence, your attorney will also:
- Assess damages
- Consult with experts
- File paperwork
- Negotiate with the insurance company
- File a lawsuit on your behalf if the insurance company refuses to make a reasonable settlement offer

Distracted Driving Laws in Texas
As of 2017, texting while driving is illegal in Texas. This law targets drivers who are texting, playing, reading, or holding their phone to talk. Essentially, the law targets any driver who has a cell phone in their hand and is actively using it. The law does not target drivers who use their cell phones hands-free.

In Texas, driving and texting is a misdemeanor. Anyone that violates this law may receive a fine between $25-$99. Repeated offenses can result in a fine of up to $200. If a serious injury or fatality results due to texting while driving, the motorist may be fined up to $4,000 and may be faced with one year in jail.
