Texas Dog Bite Laws

Texas follows the one bite rule. Under this rule, a dog’s owner can be held liable for the injuries their animal inflicts if the owner knew about their dog’s vicious tendencies or aggressive behavior. However, dog bite laws in Texas also allow a person who was bitten by a dog to impose liability on a dog’s owner if their negligence facilitates an attack. 

Under the one bite law, a dog bite victim doesn’t have to prove that the attack or bite occurred due to the owner’s negligent handling of the dog. 
Actions brought under this law involve claims of strict liability. However, a dog bite victim can also pursue a claim against the owner of the animal under the theory of negligence. When a person fails to exercise ordinary care through an action or inaction, it is considered negligent. 

However, to prove negligence, the dog bite victim must prove several elements:

  • The dog’s owner owed a duty of care to prevent their dog from injuring others
  • The dog owner breached that duty
  • The dog owner’s breach of duty resulted in the dog attack
  • The dog bite victim suffered injuries and deserves financial recovery

In a negligence claim, the victim of the dog bite doesn’t have to prove that the dog owner knew about acts of aggression or prior attacks. Instead, the dog owner’s negligent handling of their dog results in liability for injuries inflicted by their animal.
